Powers of Attorney

Overview

It is important that you create one or more Powers of Attorney in good time to ensure that those you trust will be able to act as your lawful agent in taking important actions for you should you find it difficult to do so (for example, due to physical infirmity or a long visit abroad) or you lack the mental capacity to make important decisions yourself (for example, you are ill, unconscious or due to the onset of a condition such as dementia).

Often people do not create Powers of Attorney early enough and then if their mental capacity deteriorates quickly, it can be too late. We will provide you with a bespoke service in preparing your Power of Attorney to ensure that it meets your requirements and advise you of any other issues which you ought to consider.

We can assist you in the preparation (and registration where necessary) of the following:-

  • Lasting Power of Attorney for Property & Affairs
  • Lasting Power of Attorney for Health & Welfare
  • General Power of Attorney for Property & Affairs
  • Trustee Power of Attorney for Estates & Trusts

Lasting Powers of Attorney are particularly important once you lose the mental capacity to take key decisions since they allow your attorneys to still act for you and they also:-

  • Enable people of your choosing to be appointed without the expensive and protracted process of a Court of Protection application
  • Enable your financial affairs to be managed by your attorneys without them having to file annual reports or be supervised by the Court of Protection
  • Provide clear authority for health and welfare decisions to be taken by your attorneys including life-sustaining treatment decisions where desired

If you wish, our sole principal Julian Mark Lee can be appointed as an attorney to act in the management of your financial affairs. However, he would charge for his time for acting in this role.

Fees

Standard fees are typically as follows, including all incidental advice:-

  • Lasting Power of Attorney – one type (individual): £350 plus Vat
  • Lasting Powers of Attorney – both types (individual): £500 plus Vat
  • Lasting Powers of Attorney – one type (couple): £500 plus Vat
  • Lasting Powers of Attorney – both types (couple): £700 plus Vat
  • General Power of Attorney (individual): £150-£200 plus Vat
  • General Powers of Attorney (couple): £200-£250 plus Vat

Fixed fees may be less than stated if the matter is very straightforward, but will be more than stated if the matter proves to be involved or complex. We will advise you of any such fee variation at the earliest available opportunity and before any additional fees are incurred.

Any additional work in this area will be charged at an hourly charging rate of £130 plus Vat, with a quote or fee estimate being confirmed once it becomes possible to estimate the volume of work involved.

All fees quoted above exclude any disbursements (i.e. payments to others required to progress the matter), which you will be advised of separately at the earliest available opportunity.
